While Nebraska is known for being against the legalization of cannabis (and the many attempts to create a medical cannabis program have been fruitless), the state still has programs that make hemp agriculture legal, so knowing what is legal in Nebraska when it comes to cannabis is a little bit confusing.
So, is CBD legal in Nebraska? Are there any exceptions for CBD, or does it fall under the same strict laws that other cannabis-related products face?
Well, we’re happy to inform you that Nebraska has a more flexible stance on CBD, and CBD that is derived from hemp was removed from Nebraska’s controlled substances list following the legalization (see also: Is CBD Legal In Nevada?)of the 2018 Farm Bill.
While this is cause for celebration, before buying CBD in Nebraska, it’s still a good idea to read up on what the law says about it exactly so you don’t get in trouble.
What Does The Law In Nebraska Say About CBD?
Before the 2018 Farm Bill was enshrined in law, Nebraska passed a bill to create a hemp agriculture plan, but this old legislature only gave access to hemp to the state Department of Agriculture and some approved colleges.
That year governor Doug Peterson put out a statement that legalized CBD (see also: Is CBD Legal In Wyoming?)in medication approved by the FDA or distributed in conjunction with the research program of an approved college.
Despite this, you could still find CBD on Nebraska’s controlled substance lists.
In May 2019, the new governor – Pete Rickets – signed LB 657 into law.
This bill was unofficially referred to as the Nebraska Hemp Farming Act. This law was similar to the hemp pilot programs of more progressive states such as Colorado and Kentucky. This bill opened up hemp access to farmers all over Nebraska.
It also reclassified hemp to become in line with federal definitions, stating that any cannabis product with below 0.3% THC by weight would now be considered hemp.
The bill does not make an explicit mention of CBD, but the new definition did include ‘extracts or cannabinoids,’ essentially legalizing CBD (see also: Is CBD Legal In Maryland?)derived from hemp.
This bill places few regulations on CBD products, besides from stating that hemp manufacturers and growers have a state license in line with the 2018 Farm Bill.
The controlled substances list was also amended to remove CBD derived from hemp, so now cannabidiol is available across Nebraska. However, the government has made no overt statements on CBD or how you’re allowed to use it.
Nebraska has relaxed its stance on CBD laws considerably, and is more flexible on the subject when compared to states like Georgia, Minnesota, and California.
Where Can You Buy CBD In Nebraska?
The laws in Nebraska now allow for the selling and manufacturing of CBD, and you can now find a range of CBD items in your local stores! However, the state hasn’t imposed any regulations regarding product safety, and so you must still be very careful when buying CBD in Nebraska.

Buying CBD directly from the manufacturing process gives you a better idea of the manufacturing process, and finding out where the brand sources their hemp and how they test it can help you make sure that the CBD products you’ve purchased are of good quality, safe, and legal.

Can 18-Year-Olds Buy CBD In Nebraska?
This is a bit unclear, as there is practically no indication of the legal age you can buy CBD (see also: Is CBD Legal In Kansas?)storesproducts in Nebraska’s federal regulations.
Ideally, CBD should be available to everyone, particularly since it’s becoming a popular and effective treatment for a variety of common childhood ailments.
However, this doesn’t mean all CBD products are suitable for all ages, such as CBD vaporizers or smokable hemp flowers.
While laws may differ from jurisdiction to jurisdiction, these rules are often at the discretion of the seller.
Because the legal age to buy tobacco products is now 21, a lot of smoke stores may prohibit anyone under the age of 21 from buying CBD products from their store.
Can You Get A Doctor’s Prescription For CBD In Nebraska?
You don’t need a prescription to be able to get access to CBD in Nebraska. Actually, doctors usually can’t ‘prescribe’ over-the-counter CBD products. Rather, they can only recommend them.
In states that have legalized medical marijuana, you just need a doctor’s recommendation to be able to access it, rather than a prescription.
Because CBD is still a relatively new product in the medical world, the FDA has currently just approved one CBD product.
This is GW Pharmaceuticals’ Epidiolex, which is designed to treat rare forms of childhood epilepsy, and has strict guidelines for usage.

Nebraska wasn’t alone in introducing a hemp research plan before the 2018 Farm Bill was even passed, similar to a lot of states. However, the state has now updated legislation so CBD is no longer on their controlled substances list.
