Is CBD Legal In Kansas?

In the 2018 Federal Farm Bill, hemp was formally redefined as an agricultural commodity. In this bill and in many other states, hemp-derived CBD became legal if it contained less than 0.3% of THC.
However, every state has the power to regulate federal laws. In May 2018, the Senate Bill 282 updated the definition of marijuana. With this bill, the definition of marijuana did not include cannabidiol or CBD.
So, while the legal status of marijuana remained in place, CBD was the exception to this status.
This bill authorized the sale of CBD in various forms, including topicals, pills, oils, or powders. However, according to Senate Bill 282, Kansas restricted the use of CBD sales unless they contain 0% THC.

Kansas CBD Laws: Senate Bill 263
Senate Bill 263, also called the Alternative Crop Research Act, was signed in April 2018.
This Kansas state law authorized the KDA, also known as the Kansas Department of Agriculture, to work within the confines of the 2018 Farm Bill to grow and cultivate hemp.
Residents of Kansas were also granted the ability to participate in any research programs regarding hemp and the KDA.
Hemp pilot programs were also authorized, but the KDA was required to provide yearly hemp licenses to those wishing to participate.
Kansas CBD Laws: Senate Bill 282
As previously mentioned, this Senate Bill updated the definition of marijuana, which excluded CBD.
Therefore, CBD derived from hemp became legal(see also: Is CBD Legal In Wyoming?). However, unlike the Federal Farm Bill which permitted CBD with 0.3% or less THC, Kansas requires its CBD to have no traces of THC.
Kansas CBD Laws: Senate Bill 28
Claire and Lola’s law, also known as Senate Bill 28, was signed in May 2019. This law prohibits agencies in the state from instigating child protection powers against parents who used and possessed medically-recommended CBD oil.
Kansas CBD Laws: House Bill 2167
This bill legalized hemp to be produced commercially, thanks to the establishment of the Commercial Industrial Hemp Program.
It also necessitated the KDA submit a plan to the USDA, the United States Department of Agriculture, regarding their actions on how they would regulate industrial hemp production in Kansas.
The USDA approved the program, allowing research distributors, processors, and hemp growers to partake in commercial hemp production.
However, the program is currently on hold (since Nov 2020) until the KDA completes the formal implementation of the proposed regulations of the program.
So, as it stands, residents of Kansas can grow industrial hemp if they hold a license given to them via the program. They must pay $200 for every application, and $47 for a background check.
What Are The Labelling Requirements Of CBD Products?
Any CBD products sold in the Sunflower State must be labeled in the correct way by both sellers and manufacturers.
These products must include a list of every ingredient used in the product, a statement guaranteeing its purity, and the name and address. of the manufacturer.
Not only that, but all Kansas CBD products need to contain a disclaimer stating that they do not contain any THC.

In Kansas, you can buy CBD in various forms. It is typically sold in the form of topicals, vape e-liquid, capsules, gummies, and tinctures. You can buy CBD online through the official websites of various CBD brands.

Does Kansas Have A Medical Marijuana Program?
Currently, Kansas does not have a medical marijuana program.
A medical marijuana program was proposed in 2017. In this proposition, the Cannabis Compassion and Care Act would be permitted to decriminalize cannabis for people with debilitating medical conditions to use.
However, this bill was shut down by legislators and did not become part of Kansas law.
