Is CBD Legal In Wyoming?

CBD oil is one of the fastest growing industries in America. In fact, according to the National Hemp Association, the CBD market alone could reach $2.3 billion by the end of 2022.

While many people use CBD oil to treat chronic conditions like arthritis, cancer, epilepsy, and PTSD, there are still some states where you cannot legally buy CBD oil.

However, that does not mean you cannot find CBD products in those places.

Legalities 

CBD oil is legal in Wyoming, as long as it contains no more than 0.3% of tetrahydrocannabinol (THC). In fact, there are several ways to obtain CBD oil legally in Wyoming.

You can buy it online, or go to one of the dispensaries throughout the state. 

The legality of CBD (see also: Is CBD Legal In Nevada?)oil varies widely across the United States. Some states, like California, allow people to use CBD oil without a prescription, while others, like Mississippi, do not recognize it at all.

Despite being neighbors with Colorado, where recreational marijuana use is legal, marijuana is still illegal for all purposes in Wyoming.

And despite the legalization of medical cannabis in 2013, the state doesn’t allow people to grow pot plants for personal consumption.

But that hasn’t stopped some entrepreneurs from trying to cash in on the booming market for cannabidiol oil (CBD), a compound found in both hemp and marijuana.

Hemp Production 

In 2016, Wyoming became one of four states to legalize industrial hemp production. While the plant itself is illegal, CBD derived from hemp is perfectly legal (see also: Is CBD Legal In Hawaii?)under federal law.

However, because CBD is derived from the same plant as THC, it must meet strict testing requirements set forth by the Drug Enforcement Administration (DEA).

The DEA says that the amount of THC allowed in products sold over the counter is 3%, while those sold in pharmacies are 0.5%. Products containing over that amount of THC cannot be legally sold anywhere.

Because the DEA doesn’t allow CBD products to contain more than 0.3% THC, some consumers are being ripped off.  For example, many companies sell CBD products online, making it difficult to know exactly what you’re buying.

Some sellers advertise that their product contains CBD, but actually just contain hemp seed oil. Still others sell products that contain CBD, but fail to disclose how much THC is present.

To avoid falling victim to these scams, consumers should check out reviews of CBD products. You can find information about whether a particular product is safe and effective on sites like WebMD, Leafly and Weed maps.

What About Medical Use? 

In 2015, the state government of Wyoming introduced House Bill 32 that allows patients with intractable epileptic seizures to use cannabidiol (CBD), a compound found in cannabis plants, to treat their condition provided the extract contains a minimum concentration of CBD and no more than 0.3% tetrahydrocannabinol (THC).

However, Wyoming hasn’t created a framework for the cultivation, processing, and distribution of marijuana, so the program isn’t actually operational.

There are also no regulations regarding the quality of products sold under the law, nor do doctors have any legal protection for prescribing CBD (see also: Is CBD Legal In Kansas?)oil to patients.

Dispensaries 

The best place to find CBD oil in Wyoming is probably at a dispensary. However, dispensaries don’t sell CBD oil directly to consumers. Instead, they sell cannabis flowers, extracts, edibles, and concentrates.

Most dispensaries offer free delivery, making it convenient for customers.

Online 

You can also buy CBD oil online, either from retailers like Amazon or from a third-party seller on sites like eBay and Etsy. 

Many sellers ship nationwide, although shipping times vary depending on location. Make sure you do lots of research on buying CBD online to learn how to make an effective purchase.

Penalties 

The state seems to be easing up on its penalties for those caught with CBD oil that exceeds the federal limit of 0.3% THC.

Under HB171, anyone caught with CBD oil that contains over 3% THC faces a misdemeanor charge with penalties ranging from one day in jail and a $500 fine to six months in prison and a $2,000 fine.

Age 

It’s unclear whether CBD products should be available to everyone at any time.

However, most CBD products are safe for children and adults alike. Some products may not be appropriate for certain groups of people, including pregnant women and individuals who suffer from specific health conditions.

There are no statewide regulations for the legal purchase of CBD in Wyoming. However, these laws may differ from one county to another and are more heavily influenced by the seller than the buyer.

It is not clear whether CBD is subject to the same 21-year minimum buying requirement.

Many CBD companies allow customers who are at least 18 years old to order their products online and will deliver them to Wyoming.

Final Thoughts 

As of September 2019 the FDA doesn’t permit CBD-infused foods, beverages, or dietary supplements to go on sale, and has yet to reach a decision on whether to regulate hemp-based CBD (cannabidiol) oils. 

While the FDA slowly but surely moves toward making new rules for CBD, the growing divide between regulated CBD and everything else leaves shoppers vulnerable to buying low quality goods. 

Even though CBD oil is legal (see also: Is CBD Oil Legal In New Mexico?)in Wyoming, it still faces challenges. For example, the state doesn’t require companies to disclose whether they test for pesticides, heavy metals, microbial contamination, or residual solvents.

In fact, it’s illegal for manufacturers to even mention those things on product labels. So, consumers don’t know if they’re getting safe products.

In addition to the lack of regulation, Wyoming also lacks transparency about what goes into the manufacturing process. There’s no mandatory testing program, and no requirement that companies reveal information about their ingredients.
